Minutes of February 20, 2008 Special Meeting

Continued Conditional Use Hearing

Held at the Milford Township Volunteer Fire Co. No. 1

Meeting was called to Order by Chairman at 7:00 P.M.  And opened with Pledge of Allegiance to the U.S. Flag.

 

Supervisors Present: Robert B. Mansfield,  Chairman; Charles Strunk, Vice-Chairman; Timothy Damiani, Supervisor.

 

Attendance: Janya Awckland, Secretary-Treasurer; Terry Clemons, Clemons Richter Walsh & Reiss. Township Solicitor     Audience: 144

 

Robert B. Mansfield: ³There is cold bottled water available in the back of the room.²

 

Terry Clemons: ŒMr. Sibley, at the hearing two weeks ago was testifying. His testimony was interrupted to hear Public Comments.

At the conclusion of testimony, Public Comments will again be heard at the end of the meeting. A yellow pad is being circulated.  Please sign your name and address and put a check in front of your name if you spoke at the hearing two weeks ago.

Because of a conflict in schedules Carl Weiner is not here tonight representing the Joshiıs. Bernadette Kearney is here in his stead. ³

 

Patrick Truman  representing the  twenty eight churches of the  Quakertown Ministerium  and  David and Constance Gahman, 2130 Weiss Road  and ŒKingıs Men² asked to become  a party (pro hoc vichy).

 

Glen McGogney objected to Mr. Truman acting as an attorney since he was not licensed in Pennsylvania.

 

Terry Clemons: ³Let the record reflect Supervisor Robert B. Mansfield was not available  for the February 6th meeting because he took ill.  The notes of that hearing will be transcribed and Mr. Mansfield with read the transcript and look at the exhibits.²

 

7:22 p.m. sign in pad came back with names of people who wished to speak.

 

Terry Clemons gave Township Exhibit 5 ŒA list of potential conditionsı to Mr. Sibley, Mr. McGogney, Bernadette Kearney and the Court Reporter.

 

Robert B. Mansfield: ³Since we donıt have a mike for the Board (only for Mr. Sibley and Mr. McGogney)  anybody having trouble hearing can move forward into the empty seats.²

 

Mr. Sibley would not comment on conditions. 

All memorandum  on conditions should be sent to Terry Clemons by March 7th.

Mr. Clemons will distribute them the Friday before the March 18th Hearing. 

The Board of Supervisors will conduct deliberations at the March 18th Meeting in the Township Building at 7 p.m. The Board of Supervisors may decide to add or delete conditions.

No comments will be heard at that meeting.  On March 25th at 5:30 p.m. in the Township Building at the Boardıs Work Session the conditions will be on the agenda.

 

 

8:05 pm.

Glenn McGogney asked questions of Mr. Sibley.

8:10 p.m. Bernadette Kearney asked Mr. Sibley questions.

She submitted photos of park area marked J2, J 3 and J4 as evidence.

8:35 pm. Mr. Truman was asked if he wanted to ask questions He conferred with Ms. Kearney.

Mr. Truman did not want to  give testimony.

Mr. McGogney did not want to ask question or testify.

Ms. Kearney had no further questions.

8:40  pm Chairman recessed meeting for five minutes.

8:52 pm  Chairman called meeting back to order.

Mr. Truman submitted three documents marked P1, P2, and P3. on effects on population of strip clubs.

 

Mr. McGogney submitted five documents rebutting Mr. Trumanıs documents.

 

9  p.m.  Terry Clemons: Œ Public comment and then Council will make closing statements.  All comments are to be addressed to Board of Supervisors.

The Board of Supervisors is acting as a quasi judicial board  and will be deciding based on the evidence recorded by Court Stenographer and will not be answering questions. If you have any comments, they should be addressed to the Board.²

 

9:37 pm.   Public Comment concluded.

Terry Clemons  read Section 701.1 Sunshine Act  which covers why Board of Supervisors has to hear public comments during their regular and special meetings.

 

Copy of deed to open space was accepted as Exhibit J 1.

9:36 pm. Glenn. McGogney make closing remarks.

Bernadette Kearney make closing remarks.

Patrick Truman made closing remarks.

9:57 pm. End of Public Comment.

Terry Clemons: ³The next time this will be on  Board of Supervisors Agenda is March 18, 2008 at 7 pm. In the Township building.²
