Meeting was called to Order by Chairman at 7:00 P.M. And opened with Pledge of Allegiance to the U.S. Flag.

 

Supervisors Present: Robert B. Mansfield, Chairman; Charles Strunk, Vice-Chairman; Timothy Damiani, Supervisor.

Approval of Minutes of Previous Meeting

Timothy Damiani made a motion to approve the Minutes of the March 18, 2008 Regular Meeting as circulated. Motion was seconded by Robert B. Mansfield and passed. Robert B. Mansfield, aye; Timothy Damiani, aye; Charles Strunk, aye.

 

Timothy Damiani made a motion to approve the Minutes of the March 25, 2008 Work Session as circulated. Motion was seconded by Robert B. Mansfield and passed. Robert B. Mansfield, aye; Timothy Damiani, aye; Charles Strunk, abstain.

 

Approval of Invoices for Payment

Having reviewed the invoices, Charles Strunk made a motion to approve the invoices for payment per two page list dated April 1, 2008. Motion was seconded by Robert B. Mansfield. Motion passed. Robert B. Mansfield, aye; Timothy Damiani, aye; Charles Strunk, aye. See Addendum#1.

Jeffrey A. Vey: ³Every three years, it is necessary for municipalities to decide if they want to participate. In order to participate in the Bucks County CDBG and HOME programs, the Board does not need to take action. ³

Board took no action.

d. Urwiler & Walter Planning Module 1845 Klines Mill Road (Repair)-Nash Property

Jeffrey A. Vey: ³This is a small package treatment plant. Part of the process is the Public Notice in a newspaper asking for comments.²

Charles Strunk: ³Send a letter stating the Township would like to see an overland flow to the Hazelbach.²

Timothy Damiani: ³I spoke to Paul Yaskowski at Urwiler & Walter about this and we should make a formal comment.²

e. Tıville Centennial Parade Route-June 7-request for approval to close roads.

Jeffrey A. Vey described the parade route.

 

Motion

Charles Strunk made a motion to approve the closing of Willow Stream Drive to provide for staging of the Trumbauersville Centennial Parade on June 7th scheduled to start at 3 pm and end at 5 pm. Reports:

Code Enforcement Officer-March, 2008

Jeffrey A. Vey: ŒIn March, permits were issued for four single family dwellings, nine residential accessory additions and renovations, six commercial permits and seven use and occupancies.² See Addendum # 2.

 

Public Works Directorıs Report for March 2008

David Winkler: ³The Public Works Department was very busy this month cleaning cross pipes and inlets due to heavy rains.

We also were cleaning up downed trees and branches from high windstorms.

We worked on replacing fade stop signs, filling potholes and cleaning up trash at the park and ride.

We now have a dumpster at the recycle center. This is for yard waste and will be taken to Victory Gardens to be recycled into mulch.²

 

Milford Township Planning commission

Jeffrey A. Vey: ³The Planning Commission reviewed the Johnston 2 lot subdivision on Mill Road.

The following are pending plans with time extensions on which no action was taken:

Reserve At Milford, Foulkes Mill and Allentown Road

Quakertown Interchange Associates, AM Drive

Pennıs Grant Commerce Center, Rt. 663 and Milford Square Pike

Thomas Martin, Wieand Road

T-Pike Quakertown LP at Turnpike Interchange which may be withdrawn.

Heritage Building Group (first submission) Pumping Station and Old Bethlehem Pike

Williams-Roth Allentown Road

Under Public Comment the detention basin on Reserve at Milford was discussed.

Jack Merritt asked how to deal with a reduced setback in a way that would not force a strip commercial development in PC Zoning.

 

Township Managers Report

Board of Supervisors had a tabulation of the mowing quotes in their packet.

 

Motion on Mowing Quotes

Robert B. Mansfield made a motion to accept and award the following mowing quotes:

Section 1 Spinnerstown area north of Route 663-eight areas at $475 per section and

Section 2 five small areas which include Fernbrook Park, Weisel Road Cemetery, and detention basin at Millers Run at $120 per section to M & M Landscaping

            Section 3 four areas with detention basins for $621 and Section 6 Unami Creek Park for $91 to John Dawson Lawn Maintenance

            Section 4 Township Buildings 2100 Krammes Road for $99 and Molasses Creek Park Section 5 for $99.00 to J. W. Landscaping. Motion was seconded by Charles Strunk. Motion passed. Robert B. Mansfield, aye; Timothy Damiani, aye; Charles Strunk, aye.

 

Motion on Renewal of Road Maintenance Contracts

Township has option to renew contracts in one year increments.

Robert B. Mansfield made a motion to renew contract for 40 hrs Asphalt Distributor with operator & one extra man with Traffic Control $5,520 and E-3 at $1.95 per gallon; E-3M $2.15 per gallon and contract for 60,000 square yards more or less of E-3M Bituminous Seal Coat for $52,200 to Asphalt Maintenance Solutions. Motion was seconded by Charles Strunk. Motion passed. Robert B. Mansfield, aye; Timothy Damiani, aye; Charles Strunk, aye.

Motion on Road Maintenance Contract-Materials & Paving Equipment

Robert B. Mansfield made a motion to award the following contracts:

            Bid 1 –A Aggregate-five types of stone to Highway Materials, Inc. for $48,960

            Bid 1 – B Paving materials-four types to Highway Materials, Inc. for $214,395

            Bid 1 – C Crack Sealing materials to Asphalt Maintenance Solutions $30,535

Resolution 2008-18 Authorizing the Acquisition by Purchase or Condemnation of Tax Map 23-20-58-1, 23-20-24, 23-20-24-1, 23-20-51 and 23-20-57

Robert B. Mansfield: ³The purchase totals 90 acres. The letter of intent is in the sellers hand and hasnıt been signed yet. Hopefully, it will be signed in the next day or two.

 

Robert B. Mansfield made a motion to approve Resolution 2008-18 which authorizes signature of the documents outside of meeting. Motion was seconded by Charles Strunk. Motion passed. Robert B. Mansfield, aye; Timothy Damiani, aye; Charles Strunk, aye. See Addendum # 3.

 

Disc Golf Course in Unami Creek Park

Fred Retter updated the Board on their plans for Disc Golf Course.

Fred Retter ran an PNDI search and it came back clean wit no hits.

Questions on parking. Parking should be addressed in any planning for an event.

 

Consensus of the Board of Supervisors that first phase would be 9 holes and a trail system closest to the Unami Creek Park entrance on Park View Drive. Board would then evaluate how course is working.

 

Jeffrey A. Vey: ³Thanks to Fred Retter for the work on the disc golf course. He found natural four ways and features. He spent time going out with the neighbors and respectied their concerns.²

 

Fox Bindery Final Land Development Plan-tabled

Parkside Estates-installation of pavement wearing course-escrow requirements

Pete Andersen went over Heritage Building Groupıs request to install the wearing course in the Parkside Estates Development before all the homes are built. The Municipal Planning Code allows dedication with a separate escrow.

 

Consensus of the Board of Supervisors:

1.     At least 90% of the homes in the subdivision must be completed.

2.     The developer must execute a ²short² agreement prepared by the Township Solicitor and post a cash escrow in the amount of $15,000 for each lot on which the house construction was not completed. The $15,000 would be subject to a possible 5% per annum increase for each year the lot remained without a completed house.

3.     Following completion of the house, the developer must request, in writing, the release of the $15,000 for that lot. Someone from Andersen Engineering Associates, Inc. would inspect the roadway in the vicinity of the lot in question and provide its opinion to the Township (in writing) regarding the release of the escrow. The cost for the inspection and the opinion letter would be deducted from the $15,000 escrow, prior to any release to the developer.

4.     The $15,000 per lot escrow would be in addition to any construction or maintenance bond.

 

 

 

Johnston-2 lot subdivision Mill Road

Representatives: Rodd White, Horizon Engineering and Curtis M. Johnston, owner.

Rodd White went over review letters from Milford Township Planning Commission and Township engineer.

 

Discussion on road improvements and fee in lieu of improvements.

Pete Andersen: ³$12,000 is an estimate of the cost for road improvements²

Charles Strunk: ³Does that include side walks? ³

Pete Andersen: ³Yes.²

Rodd White: ³The Water Ordinance says the existing dwelling should be hooked up to public water. Is that truly necessary. They have a functioning well. It is obvious that the new dwelling be connected.²

Robert B. Mansfield: ³Have you spoken to the Milford Township Water Authority? Unless they waive the water hook up; we wonıt waive it.²

Pete Andersen: ŒThere is a water main across the entire frontage of the property.²

Robert B. Mansfield: ³You need an agreement with MTWA.²

Charles Strunk: ³And Milford Trumbauersville Area Sewer Authority.²

Curtis Johnston indicated he had been in contact with MTASA.

Charles Strunk: ³We need a clean set of plans .²

Discussion on conditions of approval. Applicant will revise plan and send it to Pete Andersen for review in time to be on April 15th Agenda.

 

Resolution 2008-19 Streamview Escrow Release

Charles Strunk made a motion to approve Resolution 2008-19 Streamview Escrow Release #11 release $54,598.50 and leaving a balance of $396,957.07. Motion was seconded by Timothy Damiani. Motion passed. Robert B. Mansfield, aye; Timothy Damiani, aye; Charles Strunk, aye.

 

Public Comments: Robert Flack, 2265 Mill Hill Road mentioned Road Crew cleaned out storm sewer during a storm event on a recent Saturday night.
